New York’s Hudson Valley offers plenty of opportunity, but it’s important to know where individual communities stand. The state’s Office of Cannabis Management regulates the cultivation and distribution of marijuana and related products, and the rules can vary widely within county lines. Having the right guidance is the first step to helping your cannabis business thrive.
Hudson Valley Cannabis Guidelines
Much of the region permits and licenses establishments to cultivate marijuana for medical and adult use. Each county has guidelines for growing space, such as indoor growth only in Dutchess County and specifications for both greenhouse and outdoor growth in Ulster County. Individuals aged 21 and over can cultivate a set number of plants divided between mature and immature plants.
The manufacturing of marijuana for adult and medical use is also allowed and includes processing, labeling, and packaging. This must be done in an enclosed facility, packaging must be child-resistant, and products must include an option with low THC levels. Additionally, the packaging must not appeal to minors, and all products must undergo safety testing from authorized providers. The sale of medical marijuana is allowed in Ulster County is allowed. Valid identification must be shown for patients to purchase medical marijuana, and they may acquire up to 60-day supplies.

Opt-Out Communities
New York’s Marijuana Regulation and Taxation Act (MRTA) gives municipalities the authority to opt out of certain allowances, particularly those related to retail and public use zoning. Currently, almost all of Green County and Putnam County have opted out of cannabis retail. Both Columbia County and Albany County have a mix of opt-in and opt-out communities.
Opting out of cannabis retail does not prohibit cultivation, processing, or distribution as allowed under New York state law.
